This privacy notice applies to any Terra Verd, LLC ("Company," "Terra Verd") service (collectively "Services") where this privacy notice is referenced, regardless of how you access or use them, including through mobile devices. This includes the Hi From Business Camp® membership program, Learning Library, and Cabin accountability spaces. This Privacy Policy incorporates by reference the Terra Verd, LLC Terms and Conditions and, for members, the HFBC Membership Agreement. Note that we combine the information we collect from you across our Services.
This Privacy Policy has been compiled to better serve those who are concerned with how their "Personal Information" is being used online. Personal Information, as described in international privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.
PLEASE READ OUR PRIVACY POLICY CAREFULLY TO GET A CLEAR UNDERSTANDING OF HOW WE COLLECT, USE, PROTECT, OR OTHERWISE HANDLE YOUR PERSONAL INFORMATION IN ACCORDANCE WITH OUR SERVICE. BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO OUR COLLECTION, USE, SHARING, AND PROTECTION OF YOUR PERSONAL INFORMATION AS SUMMARIZED BELOW.
1) Changes and Modifications
We reserve the right, in our sole discretion, to update or modify this Privacy Policy at any time (collectively, "Modifications"). Modifications will be posted to our Services with a change to the "Updated" date at the top of this Privacy Policy. In certain circumstances Terra Verd, LLC may, but need not, provide you with additional notice of such Modifications, such as via email or in-Service notifications. Please review this policy periodically, and especially before you provide any personal data.
2) Optional / Opt-Out
Providing your personal information is optional, but it may be necessary for certain Services, such as membership registration or access to the Learning Library. If you do not provide such information, we may not be able to provide you with the requested Services.
3) Information We Collect and How We Process Data
We are a data Processor and Collector. We process data received from our Services and take proportionate precaution in storing such information on our secure servers until it is no longer needed for the purposes described below. The personal information we collect depends on the context of your interactions with Terra Verd and the choices you make, but can include the following:
a) Automatically collected information, such as your IP address, device ID, and browsing activity, in order to provide, maintain, and improve our Services.
b) Account and membership information, such as your name, email address, username, password, and other authentication credentials used to register for and access HFBC membership.
c) Learning Library and Cabin activity, including your progress through educational materials, responses to quizzes, assessments, and reflection exercises, Cabin assignment history, and participation activity within your Cabin. As described in the Membership Agreement, these assessments are educational tools, not diagnostic instruments, and your responses are not evaluated by a licensed professional.
d) Payment and billing information, such as your billing name, billing address, subscription plan and status, payment history, and renewal information. Full payment card details are collected and stored directly by our payment processor, not by Terra Verd (see Section 4(f) below).
e) Information you provide to us, such as when you complete a form on our website, contact support, respond to a survey, or otherwise communicate with us.
f) Location information. Certain Services may request permission to access your location. Where you grant this permission, we will collect location information using GPS, wireless, or Bluetooth technology. You can control access to precise location information through your device settings.
4) How We Share Your Personal Information
Terra Verd does not sell your personal information to others. We share your personal information only as described below.
a) Internal business purposes, including to improve the content and functionality of the Services, better understand our members, protect against or address wrongdoing, enforce our Terms and Membership Agreement, manage your account, and provide customer service.
b) Transactions involving third parties. We make available Services, software, and content provided by third parties. We share information related to those transactions with that third party.
c) Protection of us and others, including to comply with the law, enforce our agreements, or protect the rights, property, or safety of Terra Verd, our members, or the public.
d) Affiliates. We may share your personal information with companies affiliated with Terra Verd through common ownership, including Ruoom, Inc., which designed, built, and maintains the HFBC platform on our behalf. The HFBC platform is hosted on Railway. Ruoom, Inc. and Terra Verd, LLC are separate legal entities under common ownership, and Ruoom, Inc.'s access to your personal information is limited to what is necessary to build, host, and maintain the platform.
e) With your consent.
f) Service providers. We share your Personal Data with contractors and service providers who perform business functions on our behalf. This currently includes Stripe, Inc., which processes membership subscription payments and one-time purchases. Terra Verd does not store your complete payment card number; Stripe retains payment card information subject to its own privacy practices and PCI-DSS obligations. Terra Verd retains only what is necessary to administer your membership, including billing status, subscription type, payment history, and renewal date, consistent with Section 8 of the Membership Agreement.
We are not responsible for the actions of our service providers, or their downstream service providers, with respect to your Personal Data. We encourage you to review their applicable policies before providing information in connection with their services.
5) How Long We Keep Your Personal Information
We keep your personal information for as long as required to fulfill the purposes described in this Privacy Notice, including administering your active membership, or for other essential purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements. If you cancel your membership, we retain billing and transaction records for the period required by applicable tax and accounting law, and delete other account data within a reasonable period thereafter.
6) International Privacy Laws
If you are visiting the Services from outside the United States, you are sending information, including Personal Data, to the United States where our servers are located. That information may be transferred within or from the United States depending on the type of information and how it is stored. These countries, including the United States, may not have data protection laws as comprehensive as those in your country of residence; our collection, storage, and use of your Personal Data will at all times continue to be governed by this Privacy Policy.
7) Dispute Resolution
If you have a complaint about our privacy practices, please contact us. We will take reasonable steps to work with you to resolve your complaint in accordance with our Terms and, where applicable, the Membership Agreement.
8) General Data Protection Regulation (GDPR)
The legal grounds we rely on to process your Personal Data will typically be because: (a) you provided your consent, or it is necessary for our contractual relationship with you; (b) the processing is necessary for us to comply with our legal or regulatory obligations; or (c) the processing is in our legitimate interest.
9) Nevada Residents
Under Nevada law, certain Nevada residents may opt out of the sale of "personally identifiable information" for monetary consideration. We do not engage in such sales; however, if you are a Nevada resident who has purchased services from us, you may submit a request to opt out of any potential future sales by emailing us. We will take reasonable steps to verify your identity and maintain your request in the event our practices change.
10) Rights for California Residents
If you are a California resident, the California Consumer Privacy Act (CCPA) may provide you with additional rights, including the right to access, know what is collected and whether it is sold or disclosed, request deletion, opt out of sale, and not be discriminated against for exercising these rights. You can exercise these rights by emailing info@hifrombusinesscamp.com. We will try to respond to a verifiable consumer request within 45 days of receipt.
11) Transfers of Personal Data
We may need to transfer your Personal Data outside the country from which it was originally provided, intra-group or to third parties located in other jurisdictions.
12) Third Party Links
The Services may contain links to other websites not operated or controlled by us. This Privacy Policy does not apply to those third-party sites. We suggest contacting those sites directly regarding their privacy policies.
Some links on our Services, including book recommendations linked to Bookshop.org within the Learning Library, are affiliate links. If you make a purchase through one of these links, we may earn a commission at no additional cost to you. We use Bookshop.org because it shares its profits with independent bookstores.
13) Third-Party Privacy Practices
If you disclose your information to a third party, or visit a third-party website via a link from our Services, their privacy notices and practices will apply to any personal information you provide to them.
14) Legal Requirements
We may disclose your Personal Data if required by law, such as in response to a subpoena, court order, or government request, or in the good-faith belief that disclosure is necessary to comply with a legal obligation, protect our rights or property, investigate wrongdoing, protect personal safety, or protect against legal liability.
15) Security
The HFBC platform is hosted on Railway. Your personal information is contained behind secured networks and is only accessible by a limited number of persons with access rights, who are required to keep the information confidential. Payment card data is never transmitted to or stored on our servers; it is collected directly by Stripe. All transactions and data in transit are secured with HTTPS/TLS. Although no method of transmission over the internet or electronic storage is 100% secure, we follow generally accepted industry security standards.
16) Your Rights and Choices
You have choices about the collection and use of your personal information, though declining to provide certain information may limit your ability to use certain Services.
a) Account information. When logged into your HFBC account, you can access, add, or update several types of personal information, as well as your membership and communication settings.
b) Marketing communications. If you do not want to receive promotional communications from us, you can unsubscribe using the link in any marketing email or by contacting us directly.
c) Browsers and devices. Most browsers and devices allow you to prevent, be notified of, or disable cookies. See our Cookie Notice for more information.
17) Children's Personal Information
HFBC membership is intended for individuals who are at least 18 years old, consistent with the eligibility requirement in our Membership Agreement. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us using the information below and we will take steps to delete it.
